NIC Bank is opening a Platinum Bank Branch in December and are searching for the ultimate outfit design for the branch staff employees. The NIC Platinum Challenge is an exciting platform for creative driven stylists to showcase their talents. It is open to Kenyan residents and as at all levels of experiences, including students, apprentices and professional stylists. Only one winner shall be selected.
TERMS AND CONDITIONS
These terms and conditions template shall be used and apply for use on different social media platforms with basic interactive features. These platforms remain the property of NIC Bank limited whose registered office is at NIC House, Masaba Road of P.O Box 44599-00100 Nairobi.
NIC Bank Limited does not make any representation or warranty whatsoever about any job vacancy arising out of this campaign or by virtue of any links/advertisements from NIC Bank Ltd website or social media platform.
NIC Bank Ltd does not exercise any control over any linked website or its owner and does not make any representation as to the quality, security or integrity of linked sites.
NIC Bank Ltd shall not accept any liability for the use by any third party of any of the entrants’ material posted on their website or any social media platform, or other information provided by you, forwarded to a third party.
Color considerations: Silver and blue with hints/touches of any or all of our corporate colors. Corporate colors can be found on the color strip that we have on our artwork on our various social media platforms.
Ladies outfit designs*: The design should represent dresses, skirt suits, blouses, trouser suits, dresses and scarves (if applicable).
Gents outfit designs*: The design should represent suits, shirts and trousers.
Fabric considerations: The type of fabric should be clearly indicated on the sketches. All suggested fabrics should be comfortable to wear.
*The designs should depict elegance, sophistication, formality and style.
All entrants represent and warrant that they are either: (a) at least eighteen (18) years old, or (b) the parent or guardian of a child at least Thirteen (13) years old and on whose behalf you are agreeing to these Terms and Conditions (a “Minor User”).
If You are a parent or guardian of a Minor User, You agree that You are responsible for the acts or omissions of such Minor User, You agree that the Terms and Conditions govern the use of this campaign by such Minor User, and You are responsible for ensuring that the Minor User complies with the Terms and Conditions.
A person may submit a maximum of three (3) different designs. A person has the option to submit 1 to 3 designs.
All entrants represent the following;
that they do not have in place any existing agreement limiting the use of their name, pictures and designs/sketches;
any other existing agreement or arrangement that would prohibit them from submitting their design elements/sketches into this competition; or
any other existing agreement or arrangement that would require NIC Bank Limited to pay fees to any third party for the use of their designs or sketches in any media.
All entrants must agree to the terms and conditions of the competition, and will be required to sign a contract should their designs/sketches be chosen. Winners may be required to sign additional contracts, including, without limitation, a disclaimer and release, copyright related contracts and contracts relating to prizes. If they fail to sign such contracts, the organizer may disqualify them from the competition or receiving prizes.
The organizer shall be entitled to disqualify any entrant or entry from the competition if the organizer determines, in its sole and absolute opinion, that an entrant did not comply with these terms and conditions or tampered or interfered with the entry and judging process or any other part or aspect of the competition or the running of the competition.
How to Enter
The competition opens on 13th October 2015 and closes on the 27th October 2015 at 17h00 (“the competition period”). No entries will be accepted outside the aforesaid period.

The competition is open to all Kenyan residents, subject to the terms and conditions noted herein.
The winner of the competition will receive a cash prize of KES 50,000.
All Entrants must be Kenyan residents of at least eighteen (18) years old, or if not a parent or guardian of a child at least Thirteen (13) years old and on whose behalf the parent or guardian shall agree to these Terms and Conditions.
All entrants may submit a maximum of three (3) different designs.
All entrants in the competition must provide the organizers with their full names, relevant identification, address and contact details (telephone and email)
The Cash prize is non transferable, and will be paid directly into a valid NIC bank account open in the winner’s name subject to fulfilment of all the requisite account opening requirements.
Upon payment of the cash prize into such bank account referred in clause four (4) above, NIC Bank will be seen to have complied with awarding the prize in fulfilment of this activity.
All Entrants warrant that their entries into the competition are original and that no third parties have any rights in the entries.
The winner grants the organizer all rights to use in any manner and form and to reproduce the designs and sketches in any medium and format, and no payment excepting the winning prize shall be due to winners relating to such use.
The organizer shall not be obliged to use the winning design and sketches in the form submitted. The organizer shall be entitled to amend or adapt such design(s) and sketches to suit their purpose.
Apart from cash prizes for which winners might qualify, the organizer will not be liable to make any further payment to the entrant(s) based on the entrant’s participation in this competition. Participants shall not claim and will not be refunded for any expenses they incur during the submission period of the designs.
NIC Bank reserves the right to withhold payment of the cash prize and the awarding of other prizes until such time as it has satisfied itself that there are no violations by the entrant or winner of any rights in relation to the works submitted and/or any third parties or any other element of the future use of the winners’ entries by NIC Bank Group Ltd and any of its employees, representative or management.
All entrants including the winner agree to be photographed and interviewed by members of the media in relation to this particular competition. No royalties or compensation will be paid to them in respect of such interview(s).
The winner gives NIC Bank permission to use the winner’s names, photographs, design sketches and testimonials in any form of media after the competition for any promotion without further compensation.
Winners waive all rights in their entries and hereby indemnify NIC Bank Limited against any claims from any third party relating to use and exploitation of the winning entry.
The organizer reserves the right to interview and conduct necessary background checks on all entrants including minor entrants under the supervision of the parent and guardian, to verify their eligibility to this competition. All Entrants and parents/guardians of minor entrants shall sign written consents agreeing to such checks, if required so to do by the organizer.
The organizer shall have the right to disqualify any entrant upon satisfaction of their illegibility to the competition.
The organizer shall be entitled not to choose a winner or award one or more prizes if an insufficient number of entries were received or the quality of the entries/designs were not of a sufficient or appropriate standard (as determined in the organizer’s discretion).
The organizer reserves the right to suspend or terminate this competition should it deem it necessary to do so.
NIC Bank Ltd, its personnel, officers, employees, advertising agencies, agents and contractors (“the indemnified parties”) shall not be liable for any loss, costs, claims, expenses or damages whether direct or indirect, arising from entrants’ participation in the contest or from the acceptance or use of any prize awarded. All entrants, by entering into the competition, indemnify the NIC Bank Limited and all its agents from any liability, loss, damage, costs or expenses incurred as a result of the contestant’s participation in the contest or from the use of any prizes awarded.
Entrants shall ensure that their entries reach the organizer in the manner prescribed above. The organizer and/or NIC Bank Limited shall not be liable or responsible for any entry that has not been received or that has been omitted from participation in the competition for any reason whatsoever. The organizer and/or NIC Bank Limited will not be responsible for delayed or lost entries or entries that are not received by the organizer.
By participating in the competition, participants agree to their personal information being entered into the organizer’s databases. By providing the organizer with their details, participants acknowledge and agree that the organizer may use such details to contact them regarding upcoming promotions, special offers, product launches from time to time. Participants may unsubscribe from the organizer’s mailing lists by following the relevant hyperlink that is provided in correspondence from the organizer.
Should entrants fall foul of any of the above listed terms and conditions, the entrant will forfeit the prize on offer should they win, and the management of NIC Bank Ltd and the judges will have the final discretion and decision whether or not to make use of another entry or select another winner.
If any of these Terms and Conditions are found by any court or body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other Terms and Conditions which shall remain in full force and effect. If any Terms and Conditions are so found to be invalid or unenforceable but would be valid or enforceable if some part of the Terms and Conditions were deleted, the Terms and Conditions in question shall apply with such modification(s) as may be necessary to make them valid and enforceable.
These Terms and Conditions shall be governed and construed in accordance with the Laws of Kenya and the parties submit to the exclusive jurisdiction of the Kenyan Courts.
